Welcome to InMyBooks! These Terms of Use ("Terms") govern your access to and use of the InMyBooks mobile application (the "App"), operated by Giventa ("we," "our," or "us").

By creating an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Description of Service

​

InMyBooks is an experience discovery platform where users can explore new activities and things to do in their cities for leisure, entertainment, and adventure. The App serves as a social digital diary for users to journal their personal experiences and share recommendations with the community.

2. Core App Features & Interactions

​

You agree to use the following interactive features in accordance with our community standards:

​

  • Lists: You can create customized lists to record, categorize, and rank your favorite experiences on various topics.

  • Journals: You can rate and review individual restaurants, dishes, activities, and stay experiences, organizing them into personal collections for quick reference or public sharing.

  • Ask: You can post questions to ask for recommendations and connect with other users in your city to get local answers about leisure, entertainment, and adventure.

3. Account Types

​

We offer different account types depending on how you interact with the platform:

​

  • User Accounts: Designed for individual consumers to journal personal experiences, create lists, and interact with the community.

  • Business Accounts (Future Feature): Designed for local vendors, merchants, and experience providers (e.g., restaurants, workshops, stays). Business accounts will be subject to additional verification, commercial guidelines, and potential premium fees to manage their business presence, respond to reviews, or promote listings. Commercial exploitation of a standard User Account for business promotion is strictly prohibited.

4. User-Generated Content (Text, Ratings, and Images)

​

You retain ownership of the journal entries, lists, questions, answers, reviews, ratings, and photographic images you post on the App ("User Content").

​

  • License to Us: By uploading or posting User Content (including images), you grant Giventa a worldwide, non-exclusive, royalty-free, perpetual, transferable license to host, display, reproduce, modify, and distribute your content across the platform.

  • Image and Content Restrictions: You promise that you own the rights to any images or text you post. You strictly agree not to upload images or text that contain graphic violence, explicit content, copyrighted material belonging to others, or privacy violations.

  • Content Removal: We reserve the right to remove any User Content, lists, or images that violate these terms or are deemed inappropriate by our moderation team.

5. Prohibited Conduct

​

When interacting with the community on InMyBooks, you agree not to:

​

  • Post fake, fraudulent, commercially paid, or spam reviews, ratings, or lists.

  • Harass, abuse, stalk, or defame other users through the "Ask" feature or comment sections.

  • Upload malware, malicious code, or use automated scrapers to harvest data from the App.

  • Misrepresent your location or identity.

6. Third-Party Venues and Real-World Experiences

​

InMyBooks features recommendations for real-world businesses, including restaurants, adventure providers, hotel stays, events, and workshops.

​

  • Giventa acts purely as a discovery platform and does not control, run, or endorse these third-party venues.

  • We do not guarantee the quality, safety, accuracy, or legality of any business, dish, event, or activity recommended on the App.

  • Your physical visits and interactions with these venues are at your own risk. Giventa is not liable for any injury, loss, illness, or dissatisfaction experienced at these locations.

7. Termination and Data Deletion

​

  • By You: You can permanently delete your account at any time via Settings -> Accounts -> Delete Account. Deleting your account will remove your profile and personal data.

  • By Us: We reserve the right to suspend or terminate your access to the App instantly if you violate these Terms, infringe on copyrights, or disrupt the local community.

8. Limitation of Liability

​

InMyBooks is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Giventa and its affiliates shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App, reliance on user recommendations, or real-world experiences discovered on the platform.

9. Governing Law

​

These Terms shall be governed by and construed in accordance with the laws of the country and state where Giventa is legally registered, without regard to conflict of law principles.
